Affinity Search Partners makes this website available on the terms below. The table gives the gist of each one. The clauses beneath are the terms proper, and a clause prevails over its summary wherever the two read differently.

Scope and acceptance
The terms on this page govern your access to and use of this website, which Affinity Search Partners operates. Opening, reading or otherwise using the site amounts to accepting the terms and agreeing to be bound by them. If they are not acceptable to you, the site is not for your use. Our privacy policy, which explains our handling of personal information, forms part of the terms and is published at /policies/privacy.
The site itself
The site exists to describe the search and recruiting services of Affinity Search Partners, and its purpose is informational. Nothing on it amounts to an offer of services, an offer of employment, or an undertaking to search for any particular position or person, and nothing on it forms a contract between you and us.
Every engagement with Affinity Search Partners runs under a signed written agreement between the client and the firm. Should anything on the site conflict with such an agreement, the agreement prevails.
Business email
Affinity Search Partners may write to people whose work touches on the services we offer, such as those responsible for technology, for hiring or for running a business. Anyone receiving such an email can end further emails by answering it and saying so, in whatever wording they choose. The privacy policy sets out how we treat that request, what we hold and how to reach us.
Sample material
Every board, chart, checklist, table, timeline or number that appears on the site, or in any sample document it links to, is illustrative material prepared to show how a search can run. It reports no result of any client engagement, depicts no actual candidate, company or outcome, and promises or predicts nothing about the result of any search.
Permitted use
Lawful use is the only permitted use, and it must leave other people's use of the site undisturbed. Specifically, you agree not to:
- Disrupt or overload the site or the systems serving it, or make an attempt to.
- Reach, or attempt to reach, any part of the site, its hosting or any connected system without authorisation.
- Probe, scan or test the site or its hosting for weaknesses.
- Employ bots, scrapers or any automated means to copy, harvest or index the content, other than a search engine honouring our published crawl instructions.
- Introduce malicious code, or use the site to send unsolicited messages.
Ownership of content
The text, design, layout, graphics, logo and other material on the site are the property of Affinity Search Partners or of those who license them to us, and are protected by copyright, trademark and other laws. Viewing pages and printing them for your own reference at work is fine. Any other reproduction, distribution, modification, public display or derivative work requires our written permission.
Rights in work we perform for a client, including candidate profiles, reports and other deliverables, are fixed by the written agreement covering that engagement and not by these terms.
Outside services
The pages here link out to affinitysearchpartners.com, including its contact form, and the page's lettering is delivered by an outside font provider. Those sites and services run under terms and privacy rules of their own, which apply to your use of them. We answer for no third party's content or practices.
Warranties
We supply the site and its content on an "as available" and "as is" basis. So far as the law permits, Affinity Search Partners disclaims every warranty, express or implied, including implied warranties of merchantability, of fitness for any particular purpose, of title and of non-infringement, together with any assurance that the site is accurate, complete, current, uninterrupted, or free of errors or harmful components.
The site offers no advice of any kind: not legal, not financial, not professional, and not about employment. Decisions on hiring, pay, employment or business strategy remain yours, and you should take advice suited to your own circumstances before making them.
Liability
So far as the law permits, Affinity Search Partners and its owners, employees and agents carry no liability for damages of a punitive, special, indirect, incidental or consequential kind, nor for profits, revenue, data, business or opportunities that are lost, where these arise from or relate to your use of the site or your inability to use it, whatever the cause and whatever the theory of liability, and even where the possibility of such damages was pointed out to us.
Our liability to you in total, across every claim arising from or relating to the site, will not go beyond one hundred US dollars. Where a jurisdiction forbids a particular limitation, our liability there is limited as far as that jurisdiction allows.
Indemnity
You will indemnify, defend and hold harmless Affinity Search Partners and its owners, employees and agents against every claim, demand, loss, liability, damage and expense, reasonable attorneys' fees included, that arises from your misuse of the site or your breach of these terms.
Law and disputes
Tennessee law governs these terms and any dispute arising from or relating to them or to the site, leaving aside its conflict-of-law principles.
A dispute we cannot settle between ourselves goes to binding arbitration in Williamson County, Tennessee, conducted by the American Arbitration Association under its rules, and judgment on the award may be entered in any court competent to enter it. This clause gives way where the law forbids arbitration of a dispute; in that event the state and federal courts serving Williamson County, Tennessee have jurisdiction.
General provisions
Should a court find any provision of these terms invalid or unenforceable, that provision applies as far as it lawfully can and the remainder stands. Letting a breach pass on one occasion does not waive our right to act on a later one. These terms and the privacy policy together make up the whole agreement between you and us on the subject of this site and replace any earlier understanding on that subject. Revisions are published here with a new effective date, and continuing to use the site after that date counts as accepting the revised terms.
